United States B1/B2 — Common Questions
Most-asked questions about the U.S. B1/B2 process — fees, refusal, EVUS, length of stay.
The following notes are Htex's supplementary commentary based on public sources, not the official positions of any immigration authority. Always defer to the official source.
Can B1/B2 holders work in the United States?
B1/B2 visitor classification is not employment authorization. A visitor may conduct activities allowed for the stated visit purpose, but cannot take U.S. employment or perform work that requires a work-authorized status. The exact boundary depends on the facts, so check the State Department visitor-visa information and obtain qualified advice when an activity may resemble work. Do not describe a work arrangement as tourism or business meetings.
Does a ten-year visa guarantee six months per visit?
No. Visa validity indicates when the visa can be used to seek travel; it does not set the period of admission. At the port of entry, CBP determines whether to admit a traveler and the authorized stay. Review the electronic I-94 record after admission and leave or take other lawful action before its date. A long-validity visa therefore does not create an automatic six-month stay.
Does a visa guarantee entry to the United States?
No. A visa allows a traveler to request admission at a U.S. port of entry. CBP officers inspect travelers and determine admission, conditions, and the authorized period of stay. Carry truthful information consistent with the trip purpose and answer inspection questions accurately. A visa, EVUS enrollment where applicable, and travel arrangements do not replace the officer’s authority at the border.
Can ordinary mainland China passport holders apply for ESTA?
ESTA is for eligible travelers under the Visa Waiver Program, not a general alternative for every passport. Ordinary mainland China passport holders are not listed as Visa Waiver Program nationals solely on that passport basis. Check the official ESTA website for eligibility, including dual-nationality or other special circumstances. If ESTA is not available, a traveler may need the appropriate visa process.
Who needs EVUS registration?
EVUS applies to eligible travelers holding a People’s Republic of China passport and a 10-year B1, B2, or B1/B2 visa. Before each planned trip, check the official EVUS site for the current enrollment status and instructions. EVUS is separate from a visa and from ESTA. Enrollment does not decide admission; CBP makes entry decisions at the port of entry.
What is the difference between EVUS and ESTA?
EVUS is an update enrollment system for eligible PRC passport holders with certain 10-year visitor visas. ESTA is the travel authorization system used by eligible Visa Waiver Program travelers. They apply to different traveler groups and neither is a visa. Verify the official system that applies to your passport and travel status rather than relying on a travel agent’s general description.
What if I find errors after submitting DS-160?
Follow the current instructions from the embassy or consulate handling your application. A post may direct applicants to complete a new DS-160, bring a correction explanation, or follow a local appointment procedure. Do not conceal a material error or attempt to alter records outside the official process. Keep the confirmation page and make sure future answers remain accurate and consistent with the corrected information.
Will the interview officer review all my documents?
Not necessarily. An officer may ask only a few questions, request selected documents, or make a decision from the application and interview. Bring materials that are accurate, organized, and relevant to the stated trip, but do not assume every document will be reviewed. Answer directly and truthfully; documents should support rather than replace clear answers about your purpose, circumstances, and plans.
How many months of bank statements are needed?
There is no universal number that replaces the instructions of the post where you apply. Use current local guidance and provide records that honestly explain your financial situation and trip budget. Statements should be readable and consistent with your income or source of funds. Avoid creating artificial transfers or presenting a balance without a truthful explanation of its origin.
Will a recent large deposit cause problems?
A large recent deposit is not automatically disqualifying, but it may invite questions if it is inconsistent with the rest of the record. Keep genuine source documents available, such as a sale agreement, payroll record, or other evidence that accurately explains the funds. Do not move money temporarily to make an account appear stronger. Officers assess the overall facts, not a single balance alone.
Must I buy flights and hotels before applying?
Do not assume you must purchase nonrefundable travel before a visa decision. The State Department’s visitor-visa guidance cautions applicants not to make final travel plans or buy tickets until they have a visa. A realistic itinerary or reservation information may help explain the purpose of travel, but it should remain truthful, flexible, and consistent with the planned visit.
Can I apply without employment?
Yes, lack of employment does not prevent a person from applying, but all applicants must present their real circumstances. Explain your current activity, trip purpose, funding, and plans after the visit truthfully. Students, retirees, job seekers, and caregivers may have different supporting records. Do not invent an employer, income source, or leave approval. Local procedures and individual facts affect what may be relevant.
How do self-employed applicants prove income and ties?
Use genuine records that describe the business and its finances, such as registrations, tax or accounting records where available, client or operational documents, and personal financial records. The appropriate evidence depends on the business and local requirements. Keep the DS-160, interview answers, and documents consistent. A business document should be factual and verifiable, not written only to create an appearance for an application.
Who provides financial support for student applicants?
A student should truthfully identify who pays for the trip and how the funding is available. If parents or another sponsor provide support, records may include the real relationship, the sponsor’s financial information, and the student’s current enrollment as relevant. There is no substitute for accurate facts. The applicant should be ready to explain the trip and their own circumstances rather than rely only on a sponsor letter.
What extra documents do retirees need?
Retirees should present truthful, relevant records of their current circumstances, including pension or other genuine income, family or residence context, and travel funding where applicable. There is no universal extra-document list that determines an outcome. Follow the post’s current guidance and avoid manufacturing evidence. The interview and application should accurately reflect retirement status and the practical plan for the visit.
Is an invitation letter required for family visits?
An invitation letter is not universally required for a B2 family visit. It can provide context about the visit and host, but it does not replace the applicant’s own truthful application, financial circumstances, or explanation of travel. Follow the instructions for the location where you apply. If a letter is used, it should accurately identify the relationship, visit purpose, and proposed arrangements.
Can business visitors receive U.S. salary?
B1 business visitors must stay within permitted visitor activities and may not use B1/B2 as general work authorization. Compensation questions can be fact-specific, especially when a U.S. entity is involved. Consult official guidance and qualified legal advice for a proposed arrangement before travel. Do not assume that calling an activity a meeting makes paid work permissible, or misstate the relationship at interview or inspection.
How soon can I reapply after a 214(b) refusal?
There is no fixed waiting period that automatically changes a 214(b) decision. Before making a new application, review the refusal information and consider whether there are meaningful changes in your circumstances or information. A new fee and application are generally required. Repeating the same facts without a substantive change may lead to the same result; never alter or invent facts to reapply.
Is 221(g) a refusal or administrative processing?
A 221(g) notice is a refusal under U.S. immigration law at that stage and may request additional documents or administrative processing. The notice from the embassy or consulate explains the next step, if any. Follow it exactly and use official status channels; timing varies and cannot be predicted by a preparation service. Do not send unrequested documents unless the post’s instructions allow them.
Can I use an old visa after passport renewal?
Often a valid U.S. visa in an old passport may be used together with a new valid passport, but exceptions and passport-specific issues can apply. Verify the current State Department and airline or carrier guidance before travel. Keep both passports secure and make sure personal information is consistent. A valid visa still permits only a request for admission, which CBP assesses at the port of entry.
Can I extend my stay inside the United States?
Some nonimmigrants may apply to USCIS for an extension of stay before their authorized I-94 date, but eligibility and timing depend on the status and facts. A visa expiration date is not the same as the I-94 admission date. Use the USCIS and CBP official websites for current instructions, and do not remain beyond the authorized period while assuming an extension is automatic.
Can visa photos include glasses or retouching?
The State Department’s photo guidance generally requires a recent, clear image and restricts glasses except for rare documented medical reasons. Retouching that changes appearance or obscures natural features is not appropriate. Check the official specifications for size, background, head position, and digital upload rules before using a photo. A photo service’s claim is not a substitute for the official requirements.
Must Chinese documents be translated?
Translation needs depend on the document, the consular post’s instructions, and how the information is presented. Check the official website of the embassy or consulate handling the application before arranging translations. Where a translation is useful or requested, it should accurately convey the original and remain consistent with the form and interview. Do not alter names, dates, or financial details during translation.
Does completing Htex service mean visa approval?
No. Htex can help organize information and preparation, but it does not make visa decisions, submit official forms automatically, or control border admission. Consular officers decide visa applications and CBP decides admission at the port of entry. Use Htex output as preparation support, verify requirements through official sources, and personally complete any official submission or confirmation required by the government.
